Florida's 2023 RON House Bill: Latest to Date

Affects Amends Sections 20.37 and 292.11 of and adds Sections 296.42-296.49 and 683.1475 to the Florida Statutes.

Changes

  1. Provides that third order of admittance priority to adult health day care must be given to a veteran who has a non-service-connected disability and is unable to defray the expense of adult day health care and so states under oath before a Notary Public or other officer authorized to administer oaths.


Analysis From the summary staff analysis prepared for the bill’s hearing before the House Health & Human Services Committee: “Adult day health care is a program established by the VA with the goal of allowing veterans to have a place during the day for social activities, peer support, companionship, and recreation. The program is intended for veterans who need help with activities of daily living, who are isolated, or whose caregiver is experiencing burden. State law recognizes adult day care centers. However, facilities that operate under the federal government or any agency thereof are exempt from current state law pertaining to adult day care centers and regulation by the Agency for Health Care Administration.”

Priority for admittance to adult health day care is established in House Bill 485. Third in priority to be admitted to adult heath day care (residents of Florida and veterans who have a service-connected disability or were discharged or released from military service for disability incurred or aggravated in the line of duty having first and second priority, respectively) is a veteran who states under oath before a Notary that the veteran has a non-service-related disability and is unable to defray the expense of adult day care.
